Terms of Service
These Terms of Service ("Terms") govern your use of the mobile application TourJ (the "Service") operated by umpire (operated by EOM MINKYU as a sole proprietor) ("we", "us", "the Developer"). By creating an account or otherwise using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 14 years old (or the minimum legal age in your jurisdiction) to use the Service. By using the Service you represent that you meet this requirement.
2. Your Account
- You can create an account using email, Sign in with Apple, or Google Sign-In.
- You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
- You agree to provide accurate information and to keep it up to date.
- We may refuse to create, suspend, or terminate accounts that violate these Terms or applicable law.
3. The Service
The Service includes, among other things:
- Trip planning, itinerary management, mapping and place search
- Trip diary, ticket and document storage
- Budget and expense tracking, receipt scanning (OCR)
- AI-assisted itinerary generation (requires an AI Generation Pass) and booking/receipt recognition (available after separate consent)
- Trip sharing with other users you invite
We may add, change, suspend, or discontinue any feature at any time. Where feasible we will provide advance notice in-app or via this page.
4. Acceptable Use
You agree not to:
- Use the Service in violation of any law or these Terms
- Impersonate another person or misrepresent your affiliation
- Reverse engineer, decompile, scrape, or otherwise interfere with the Service or its underlying infrastructure
- Upload content that infringes intellectual property, privacy, or publicity rights of any third party
- Upload content that is unlawful, harmful, obscene, harassing, or that violates applicable rules
- Use the Service to send spam, malware, or to attack other users or systems
- Resell, sublicense, or commercially exploit the Service without our prior written consent
5. Your Content
- You retain ownership of all content you upload to the Service ("Your Content").
- You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, and display Your Content solely for the purpose of operating, providing, and improving the Service.
- You represent and warrant that you have the rights necessary to grant this license.
- When you delete content or your account, we will delete the associated data without undue delay, except where retention is required by law.
6. AI Features
- AI features are provided via Google LLC's Gemini API and are available only after you give separate in-app consent. Per the Gemini API Terms, AI features are limited to users aged 18 or older.
- AI-generated suggestions (itineraries, OCR results) may be inaccurate, incomplete, or out of date.
- You should treat AI output as informational only and verify any critical information (hours of operation, prices, travel restrictions, etc.) independently.
- You are solely responsible for decisions you make based on AI output.
7. AI Generation Pass and In-App Purchases
- Each AI itinerary generation uses one AI Generation Pass, a consumable digital item sold through Apple in-app purchase. The one free generation per account ended on August 20, 2026, and the first generation has required one pass since that date.
- The price and currency are those displayed by the App Store for your account and region. Apple processes payment, billing and refunds; we do not receive payment-card or bank-account details.
- We grant a pass only after our server validates Apple's signed transaction. The same Apple transaction cannot be credited twice. If the app closes or loses connectivity while validation is pending, it retries unfinished transactions on a later launch.
- A pass is consumed when AI generation begins. If the app confirms a server or network failure, the server attempts an automatic return within 12 hours and retries a temporarily failed return on a later launch. A pass is not automatically returned when you voluntarily leave after generation starts or close the app during generation.
- Refunds of the App Store purchase itself follow Apple's policy and process at Report a Problem. Nothing in this section limits mandatory cancellation, refund, or consumer-remedy rights under applicable law.
- When Apple approves a refund, unused passes granted by that transaction are withdrawn. Any quantity already used is recorded as a refund adjustment balance on the same account and blocks further AI use. Later pass purchases first offset that balance, and only the remainder is granted as new passes. The adjustment balance is not collected as a monetary debt and is used only to prevent duplicate use of refunded AI access. If Apple reverses an approved refund, we clear the remaining adjustment balance first and restore the remaining passes, including quantities already offset, to the same account.
8. Third-Party Services
The Service depends on third-party platforms including Google Firebase, Google Maps Platform, Google Sign-In, and Apple Sign-In. Their availability, pricing, and terms are outside our control. Outages, policy changes, or deprecation by these providers may affect features of the Service.
9. Suspension and Termination
- You may stop using the Service at any time and may delete your account from Settings → Profile → Delete Account.
- We may suspend or terminate your access to the Service if you breach these Terms, expose us to legal risk, or harm other users.
- Account deletion erases your cloud-stored content without undue delay, subject to the Privacy Policy's stated exceptions, including a purchase ledger with the member identifier removed. Unused consumable passes are not transferable to another account or redeemable for cash when the account is deleted.
10. Service Availability
The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. Scheduled maintenance, infrastructure incidents, or third-party outages may temporarily affect availability.
11. Disclaimers
To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, regarding the Service, including merchantability, fitness for a particular purpose, and non-infringement. The accuracy of maps, place data, AI outputs, and any external content is not guaranteed.
12. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service. Our total cumulative liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (b) USD 50.
13. Indemnity
You agree to defend, indemnify, and hold harmless the Developer from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from (a) your breach of these Terms, (b) Your Content, or (c) your misuse of the Service.
14. Changes to These Terms
We may modify these Terms from time to time. We will post any changes on this page and update the "Effective" date above. Material changes will be announced at least 7 days before they take effect, or 30 days for changes that materially reduce your rights. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought in the courts having jurisdiction under the Korean Civil Procedure Act.
